Key Considerations that Apply to Death Benefit Claims
This paper is a guide to the Tribunal's procedures when dealing with complaints relating to death benefit distributions under the Superannuation (Resolution of Complaints) Act 1993 (Cth) ("the Complaints Act"). The Tribunal reviews the trustee's decision standing in the shoes of the trustee and must not do anything that would be contrary to law or to the governing rules of the fund concerned. The Tribunal must affirm a trustee's decision if it is satisfied that the decision, in its operation in relation to the complainant, and any other party to the complaint who has an interest in the death benefit, was fair and reasonable in the circumstances.
Key Considerations that Apply to Total & Permanent Disability Claims
Key considerations that are set out in this paper apply to consideration of TPD claims by trustees and insurers. As the Tribunal uses the powers and discretions available to trustees and insurers when dealing with complaints relating to their decisions, these considerations apply equally to the Tribunal.

These are guidelines about when the Tribunal would ordinarily require persons to attend a conciliation conference and are issued pursuant to subsection 28(7) of the Superannuation (Resolution of Complaints) Act 1993 (the Complaints Act).
